Newby said there are three reasons the UW-Madison seeks to assert its trademark rights and license users of those marks: Control a university wants to make sure that the way the trademark is used reflects positively on the institution. Earlier this year Newby issued a cease and desist letter to the UW-Madison student entrepeneurs who were marketing condoms bearing the legend Get Lucky Bucky and a likeness of the irascible rodent. It was a matter of taste, explained Newby. Product liability licensing allows the university to make a determination that the product is reasonably safe, and also requires the licensee to purchase product liability insurance protecting the university from lawsuits. Newby admits its a long shot, but says the UW-Madison could have faced a wrongful birth suit if a Get Lucky Bucky condom had failed.

Income licensed manufacturers must give the UW-Madison royalties amounting to 6.5 percent of their sales. The UW has the potential this year to make $250,000 in gross revenues from the sale of licensed products, Newby said. Sales of trademark products are tied to a universitys sucess on the athletic fields, she said. The University of Michigan made $900,000 last year from trademark royalties. Michigan, Ohio State and other universities with established licensing programs maximize their earnings by entering into sophisticated agreements with retailers and manufacturers to create and promote products, including ice cream, bearing the school moniker, Newby said.

The UW-Madison will be seeking out similar lucrative promotional opportunities over the next few years, she said. The university gives people who manufacture non-traditional things like needlepoint mats or kites a break on the licensing fee. These so called cottage industries are charged a licensing fee of only $25 per person down from $250 and are not usually required to buy insurance, Newby said. Large manufacturers are required to buy at least $1 million worth of product liability insurance, she noted. Because of the negative health effects of alcohol and tobacco, the UW-Madison does not allow such products to be licensed, Newby said.

But there are probably fewer than a dozen manufacturers of goods who are not, she said. Newby said she doesnt know right now who they are. They come and go, she said, adding that she wouldnt tell the newspaper their names even if she did. Her staff plans to identify these manufacturers by walking up and down State Street and visiting various retailers of UW merchandise. The legal staff will be able to spot very quickly the merchandise that isnt licensed, and will simply ask the retailer where he got it, Newby said.

It is the manufacturer, not the retailer, of the bootleg merchandise that is responsible for getting the license. The UW-Madison is not particularly eager to sue these parties, Newby said. Rather than taking a real heavy-handed approach, we would let them know that we do assert our trademark rights and ask them to get a license, Newby said. If the party refuses, the university would probably seek an injunction ordering them to cease and desist manufacturing the bootleg merchandise, Newby said. Newby said bootleg manufacturers might resist simply because the UW-Madison hasnt asserted its trademark rights in the past.

But Newby plans to change all that. The UW has actually had a licensing agent since 1988, when former Athletic Director Ade Sponberg hired a California company to handle the licensing of products for the UW athletic department. Today more than 200 universities in the nation have entered into licensing agreements like the UW-Madisons, Newby said. Why are they so popular? A horror story often circulated among people involved in trademark licensing is the tale of Georgetown University, which did not have a licensing agent the year its basketball team won the NCAA championship. Every kid in America had a Georgetown sweatshirt but the school made no money from the sales, Newby said.

Presumably with an eye toward avoiding similar disasters, Sponberg sought out a licensing agreement for the UW athletic department. Newby, who oversaw a similar licensing program at the Univer- Grant County judge The number of attorneys being considered to replace Grant County Circuit Judge William Reinecke has been pared from six candidates to three, according to Gov. Tommy Thompsons office. Still in the competition are attorneys F. Mark Bromley of Lancaster, George S.
